Legal Process
The process of buying a property in Spain is slightly different than in the UK. There are additional documents that must be in place before you can sign for a property, which must be applied for through the correct channels. We will take care of all of this as far as possible, but there are some things that must be done in person.
In order to buy property in Spain, one of the documents that you must have by law is a Número de Identificación de Extranjero (NIE). This is a tax identification number that will also be required in lots of other situations, for example to buy a car or purchase insurance. This must be applied for in person, which can be done in one of the Town Hall offices in Spain, or through the Spanish Consulate in the UK.
If you are not able to request these documents or sign for your property in person, it is possible to give Power of Attorney to another individual to sign on your behalf. In most cases, the Power is given to a Solicitor.
If you would like to do this, the Solicitor will draw up the document and send it to you, which must be signed in the presence of a British Notary. In order to make the document legal in Spain, it must then be sent to receive an Apostille in the office in Coventry. The whole process takes approximately one week and the document can be annulled at any time.
